Schenker challenges NZ Court

GERMAN freight forwarder DB Schenker has demanded to see court papers, as it moves to challenge its New Zealand cargo price-fixing fine of more than NZ$1 million (US$766,000).
In applying to the High Court for access to court documents, Schenker hopes to uncover material which would show that as a customer of various airlines at the centre of the price-fixing allegations, it would have been subject to illegitimate surcharges.
The company’s lawyer Paul Collins told Justice Raynor Asher that Schenker was entitled to access the documents even if they included commercially sensitive material.
All airlines involved oppose the application and their submissions will be heard this afternoon in a hearing.
In June Schenker was one of three international freight forwarding companies ordered by the court to pay penalties for Commerce Act breaches.
Schenker was ordered to pay $1.1 million, BAX Global $1.4 million and Panalpina $2.7 million.
